Judge Overturns Boone County Election Board Decision Denying Zionsville Candidate Access to Primary Election Ballot

Mark Plassman's name will appear on the Primary election ballot after all. Plassman, who is a candidate for Zionsville Town Council, District 2, was challenged by his election opponent, the incumbent councilor, who sought to keep Plassman off the ballot. The Boone County Election Board also voted to keep Plassman off the ballot.

However, Montgomery Circuit Judge, Thomas K. Milligan, ruled that Mr. Plassman is entitled to be on the ballot for the May 8, 2007, primary election as a Republican candidate for the office of Zionsville Town Council, District 2.

Plassman's lawyer, William Bock, of the Indianapolis law firm of Kroger, Gardis & Regas, LLP, said, "We are happy that because of Judge Milligan's decision the voters in Zionsville Town Council, District 2, will have a choice on election day." Bock said, "Technical arguments were being used to deprive the voters of a choice and Judge Milligan found that as a matter of law Mark Plassman was entitled to be on the ballot."
